Adapting to Change: Reflections on the Evolving Legal Landscape

As lawyers, we work in diverse legal practice areas, (in my own case, I have worked with contracts and civil litigation to human rights, data protection, intellectual property, and legal design). Some of our experiences happen by chance, others by choice. Through looking inwards and assessing our experiences, we develop a unique understanding of the legal profession’s development in different settings and contexts.


The Covid-19 pandemic forced the legal sector into accelerated change on multiple fronts, including remote work and virtual courtrooms. While some lawyers and firms embraced this change, others chose to revert to traditional models when the pandemic ended.


I believe that not adapting to industry trends is a risk because our work as lawyers is now more connected than ever to the business world. New technologies are exponentially changing the way our clients manage their obligations and risk, and legal tech solutions are becoming increasingly popular, leading to higher efficiency and cost savings.


Our work as lawyers is slowly starting to move towards proactive models for legal practice. There is an increasing demand for new types of business functions associated with legal practice, such as legal ops, data science, project management, and new emerging legal practice areas related to technological growth. We are now more often required to work as part of multidisciplinary teams, using more commercially minded approaches.


Today we spend more time identifying and solving problems, providing commercial solutions and outcomes for our clients, and understanding our clients’ businesses, goals, and strategies. This means we often need to take a completely different approach to what we learned during our legal education.


The legal sector is also placing a greater emphasis on providing excellent client experience, which includes providing more transparent pricing and improving communication and collaboration between clients and legal teams. Coupled with this, we are also seeing more creative ways in which we can help our clients deal with legal issues, such as Design Thinking, Legal Design, and other innovative methods.


Data privacy and cybersecurity have become increasingly important to law practice, with the development of new regulations and industry best practices.


However, many lawyers will join the race to “react” to such changed environments, without really considering what they mean for their professional and private situations. Making such choices blindly can often lead to further challenges down the line, with professionals continuously needing to create new versions of themselves or their businesses to adapt to the latest industry developments, job specifications, and client demands.


Therefore, as lawyers, we should use a strengths-based approach to consistently focus on the positive core of strengths in our professional and private lives. This will allow us to remain balanced and engage in “self-determined change” with a focus on what is working, rather than what is not working. It allows us to bring about positive change without a core focus on “problems” or “what is wrong” in our past approach to working in the legal field.


In conclusion, we need to be the designers of our own change. We must spend sufficient time clearly identifying our goals and, when acting on these, ensure that we do not neglect the strengths or skills that have set us and our organizations apart in the past. As lawyers, we can use our diverse experiences to develop a unique understanding of the legal profession’s development and continue to adapt to the changing legal environment.
